New York’s “Scaffold Law” holds property owners fully liable in lawsuits for gravity-related construction accidents. As a result, under the scaffold Law’s “absolute liability” standard, contractors have virtually no defense from a lawsuit.
Ben says Absolute Liability should not necessarily be abolished, but it should be reformed. Many believe construction would increase substantially if it was reformed, subsequently helping the local economy.
Ben’s advocates doing everything possible to keep construction zones safe for workers, keep scaffold laws realistic, and keep the costs of insurance rates under control.
